The Regulations for Providing Electronic Services through the BRE Bank Group Internet Portal

§ 1

These Regulations define the principles on which electronic services are provided by BRE Bank SA with its registered office at ul. Senatorska 18 in Warsaw, within the framework of the BRE Bank Group’s internet portal with the web address of www.brebank.pl.

§ 2

The terms used in the Regulations have the following meanings:

Bank – BRE Bank SA with its registered office at ul. Senatorska 18 in Warsaw,

Regulations – these “The Regulations for Providing Electronic Services through the BRE Bank Group Internet Portal”,

Portal – the BRE Bank Group’s internet portal, which is a system of web pages situated on the Bank’s internet server with the following address: www.brebank.pl , being a data base of static and dynamic documents containing graphic files, scripts and other linked elements,

data communications system – a complex of inter-connected IT services and programs ensuring the processing, saving, sending and receiving through a data communications network with the assistance of the appropriate terminal devices within the meaning of the Telecommunications Act of 21 July 2000 (Journal of Laws No. 73, item 852, with subsequent amendments),

providing electronic services – the provision of services through the sending and receiving of data via data communications systems at the individual request of the User, without the presence of the parties, in that the data is transmitted through public networks within the meaning of the Telecommunications Act of 21 July 2000 (Journal of Laws No. 73, item 852, with subsequent amendments),

User – entity using the Portal.

§ 3

Pursuant to these regulations, the Bank within the framework of the Portal. Provides the User with electronic services, and in particular makes available:
1/ information the Bank’s and the Bank Group’s offer and activities, and also information of an economic and financial nature,
3/ the application “Application for an SME package” enabling the User to electronically apply to the Bank for the Small to Medium Enterprise Package in either the EFEKT or EFEKT Plus version,
5/ the application “Request for contact” which enables the User to send questions to the Bank regarding the Bank’s and the Bank Group’s offer,
7/ an application enabling the User to register in the following categories:
a/ Corporate and Institutional,
b/ Small and Medium Enterprises,
c/ Private Banking,
d/ Investor Relations,
e/ Pressroom
and to send the registered User the information ordered by him.

The provision of electronic banking services within the Internet Customer Service System interBRESOK of BRE Bank takes place on the basis of a separate agreement concluded between the Bank and the User.

The Bank provides the services stipulated in para. 1, in accordance with these Regulations.

§ 4

In order to make use of the services provided electronically, as per § 3 para. 1, it is essential that the User has access to a data communications system with the following minimum configuration: a PC with MS Windows 95, connected to the Internet, and with an internet browser: Internet Explorer ver. 6.0 or Mozilla ver. 1.5.

§ 5

The User using the Portal is bound by the provisions of these Regulations.

The User may, at any time, resign from using the services provided electronically by the Bank as specified in § 3 para. 1.

§ 6

The contents of the Portal pages, subject to exceptions clearly pointed out on that pages>, are for information purposes only and are not intended to be a commercial offer, as it is seen in Commercial Code, of services on the part of the Bank or the Bank’s Group.

§ 7

All rights to the entire contents of the Portal are reserved.

The User has the right to download or print whole pages or fragments of the Portal and to make use of the accessible applications specified in § 3 para. 1, on condition that he does not infringe the copyrights or the trademarks belonging to the bank or companies in the Bank’s Group. In particular, no part of the Portal may be copied for commercial purposes in whole or in part , transmitted electronically or in any other way, modified, linked or exploited without the prior written consent of the Bank.

§ 8

The Bank will continuously and with great care update the information contained in the Portal, However, it does not bear any responsibility for the accuracy, currency or the completeness of the information presented on the pages of the Portal

The Bank reserves the right to introduce changes to part or all of the Portal without prior notice.

The User bears the risk associated with the use and exploitation of the information presented in the Portal.

The Bank does not bear any responsibility for any damages incurred as a result of the use of the Portal by the User.

§ 9

The User, in connection with the provision by the Bank of electronic services, may not provide the Bank with content of an illegal nature.

§ 10

The User, in connection with the provision by the Bank of electronic services, as specified in § 3 para. 1, consents to the sending by the Bank, by electronic means, and in particular electronic mail, marketing information within the meaning of art. 2 pt 2 of the Provision of Electronic Services Act of 18 July 2002 (Journal of Laws No 144, item 1204) to the User.

§ 11

The User may make a complaint in connection with the provision of electronic services by the Bank pursuant to § 3 para. 1.

The User’s complaint should be sent to the Bank at the following email address: redakcjaportalu@brebank.com.pl.

The Bank shall consider the complaint within 21 days from the day that it was sent by the User.

Following consideration of the complaint the Bank sends to the User, to the email address provided by him, information regarding the result of the consideration of the complaint. The User consents to being sent marketing information within the meaning of art. 2 pt 2 of the Act cited in § 10, by the Bank in response to the complaint made by the User.

§ 12

The Bank reserves the right to amend these regulations at its discretion.

In the event of changes to the Regulations, they shall be delivered to the User by being located in the Portals pages.

§ 13

These regulations come into force on 2 January 2007.
